Various steps to trademark registration:

  • Step 1 – Trademark Application – This is a request for the mark to be registered. It takes approximately 1 to 7 days. Application to be made in Form TM A
  • Step 2 – Examination report – To obtain more information on the mark Trademark Registry issues an examination report to obtain more information on the mark. This is issued after 2to 8 months from the date of application
  • Step 3 – Reply to examination report – This is a crucial step. Here all the information required should be submitted with the Trademark Registry. This should happen within 30 days from the date of examination report or else the application may be rejected.
  • Step 4 – Advertisement – After the reply is submitted the mark is advertised to the general public and then it is open for opposition by third party or interested parties. This happens within 1 to 3 months.
  • Step 5 – Opposition – Any concerned party can file an objection to the mark within 3 to 5 months from the date of advertisement. A hearing of objections is conducted for the concerned party and applicant to submit their arguments.
  • Step 6 – Issue of trademark – If there is no objection or the objection from the opposing party is rejected, a trademark is issued to the applicant. A registration certificate is also issued in the name of the applicant.
